Please read these Terms of Service carefully before using the tremednous platform. They govern your access to and use of our API, dashboard, and related services.
By accessing or using tremednous (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, you must immediately cease use of the Service. These Terms constitute a legally binding agreement between you and tremednous, Inc.
tremednous provides a cloud-based API platform that enables businesses to send rewards, payouts, and incentives at scale. We reserve the right to modify, suspend, or discontinue any feature of the Service at any time with reasonable prior notice where practicable.
You must provide accurate, current, and complete information when creating an account. You are solely responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account. Notify us immediately at [email protected] of any unauthorized access.
All fees are stated in USD and are due in advance unless otherwise agreed in a written order form. We may update pricing with 30 days' notice. Overdue balances accrue interest at 1.5{92d6630a44ea04ca9af390d114bf7a081ab52eb2b0578df2dd0671018f161800} per month or the maximum permitted by law, whichever is lower. All fees are non-refundable except as expressly stated.
Access to the tremednous API is subject to the rate limits and quotas specified in your subscription plan. You may not resell or sublicense API access without our prior written consent. We may throttle or suspend API access if your usage poses a risk to platform stability.
All intellectual property rights in the Service, including software, documentation, and branding, remain the exclusive property of tremednous, Inc. Your use of the Service does not grant you any ownership rights. You retain ownership of your own data submitted through the Service.
You may not use the Service for any unlawful purpose, to facilitate fraud, money laundering, or sanctions violations, or to transmit malicious code. You may not attempt to reverse-engineer, scrape, or disrupt the Service. Violation of this section may result in immediate termination.
Our collection and use of personal data is governed by our Privacy Policy, incorporated herein by reference. By using the Service, you consent to data processing as described therein. You represent that you have obtained all necessary consents to share recipient data with us.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. We do not warrant that the Service will be error-free or uninterrupted.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, tremednous SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES. OUR AGGREGATE LIABILITY SHALL NOT EXCEED THE FEES YOU PAID IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
Either party may terminate these Terms with 30 days' written notice. We may terminate immediately for material breach, non-payment, or conduct that poses a legal or reputational risk. Upon termination, your right to access the Service ceases and outstanding fees become immediately due.
These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-law principles. Any dispute arising hereunder shall be resolved exclusively in the state or federal courts located in Wilmington, Delaware, and each party consents to such jurisdiction.
We may revise these Terms at any time by posting an updated version to our website. Continued use of the Service after the effective date of any change constitutes your acceptance of the revised Terms. Material changes will be communicated via email or in-app notification.
